Acceptance of Terms

This document contains the terms and conditions governing your use of the services in the web site www.astronomy.com.ph (the "Site"), including, but not limited to, reading, copying and submission of Content, and shall henceforth be known as the Terms of Service (the "TOS").

The TOS is a legal and binding agreement between you and Astronomy.com.ph governing your use of the Site. Please review the TOS fully before you continue to use the Site. By using the Site, you agree to be bound by the TOS. You shall also be subject to any additional terms posted with respect to individual sections of the Site. Please review our Privacy Policy, which also governs your use of the Site, to understand our practices. If you do not agree with the TOS, you must discontinue using the Site. Astronomy.com.ph reserves the right to change the TOS at any time without prior notice. Your access or use of the Site before or after such changes indicates your acceptance of the TOS as modified. It is your responsibility to review the TOS regularly. The last update time of the TOS is provided at the bottom of this document.

Your use of the Site is at your own risk. If you are dissatisfied with any of the materials contained in the Site, with the quality of service or Content, or with these TOS, your sole and exclusive remedy is to discontinue accessing and using the Site.

Intellectual Property Issues

Astronomy.com.ph owns the site. All of the content featured or displayed on the Site ("Content"), including, but not limited to, text, still images, pictorial works, illustrations, graphic designs, multimedia combinations, and computer programs, including web-based or server-side programs is owned by Astronomy.com.ph. Advertisements and content from third-party entities are not considered Content for the purposes of this Section. However, these content are owned or licensed by their respective third-party entities and are subject to protections set forth by these third-party entities.

Pursuant to the Philippine and international copyright laws, you agree:

1. That you may only download Content that Astronomy.com.ph designates as offered for download to any single computer a single copy of any Content for personal and non-commercial use.
2. To not reproduce, distribute, modify, repost on another web site (regardless of the server on which the Content is stored) or any other medium, including but not limited to print and broadcast media, any Content without specific written authorization from Astronomy.com.ph.
3. To not sell any Content without specific written authorization from Astronomy.com.ph.
4. To maintain any and all copyright or other proprietary notices embedded in or attached to any Content.
5. That by posting or submitting any text or other materials to the Site you grant Astronomy.com.ph a royalty-free permanent license for the worldwide use and/or sublicense of such materials. Such license shall include the right to exploit any proprietary rights in the posting or submission.

Use of Content

With respect to Content designated as available for download for educational purposes, librarians, teachers, support staff, administrators, and other staff of educational institutions are authorized to download, print, reproduce, and distribute such Content as may be beneficial for use in educational settings. This authorization extends only as far as is necessary to directly benefit students. Content subject to this Section may not be disseminated beyond the user's particular educational institution and may under no circumstances be used for commercial purposes.

Specifically, librarians, lecturers, and educational staff of any non-profit astronomical society based in the Philippines are allowed to download, print, reproduce, and distribute such Content to members of their particular astronomical society, provided these are used solely for educational purposes of their members.

Content used for any purpose must always maintain unaltered copyright and other proprietary notices. Content may not be mirrored, framed, reposted, or reprinted, on any other computer network, web site, publication, or other print or broadcast media regardless of educational use.

Content may not be used for any commercial purpose regardless of educational use.

Any attempt by any person to deliberately damage the Site is a violation of criminal and civil laws. Should such an attempt be made, the owners of the Site preserve the right to seek damages from any such person to the fullest extent permitted by law.

These TOS and any other operating rules or terms currently posted on the Site constitute the entire agreement between Astronomy.com.ph and the users of the Site, and are subject to change at the sole discretion of Astronomy.com.ph.
